It's in the fuzzy area I described as "injunctive relieve may be too severe." Injunctive relief (making someone do/not do something instead of resolving it with a money judgement) is extremely rare. Reaching back 30+ years to my contracts and remedies class, Duke is asking for a form of specific performance. A type of injunctive relief, making someone do what they contracted to do. Again, that's extremely rare. I don't know why Duke's lawyers would go that route. Maybe they've asked for a form of temporary relief, kinda like a TRO. That's a lower bar. It's basically a "let's maintain the status quo while we try to sort this out" thing. That would make a lot more sense.
