The problem is that Congress has few effective mechanisms to restrain the President beyond impeachment, especially when Trump can redirect funds from one budget item to another to finance his preferred priorities.
Musk, as a private citizen, has considerable freedom to pursue his own foreign policy initiatives. Doing so is not inherently treasonous or illegal.
