You would think that NIL deals are binding contracts. So, at first blush, you would think there is a big lawsuit coming.

But, I don't think that it would be tOSU that is in breach. It's probably their NIL collective (like MoW). Which should be sort of technically independent of the university. Sort of.


Still, maybe the player didn't meet performance clauses that were in the contract. MoW operates as a charity non-profit, and the players are obliged to make appearances on behalf of MoW. I'm guessing that most NIL collectives are similarly structured (so that one gets to write off one's donations as a charitable donation - which is, to me, a joke, like much of our tax system - why am I paying part of Ohtani's contract? I shouldn't get started).

So, maybe this guy didn't honor his side of the agreement and make the necessary in person appearances, and maybe the NIL agreement is spelled out with enough specificity that their NIL collective can show that the player didn't meet certain performance (in terms of off the field stuff) commitments?

That's the only reason I can think of that OSU's collective would put themselves in that position. It would sure be interesting to hear conversations between the collective and the athletic dept on this issue.
