Sure, but that's not for the medical examiner to determine. They just determine manner of death, like homicide, suicide, accident, natural causes, etc.
Homicide can be non-criminal, and an accident can be criminal all the way up to murder (some drunk driving killings are charged as second degree murder, for example).
