What's to prevent an athlete from hiring an agent to negotiate on his or her behalf? Why not? The agent can shop the athlete around to various collectives and find out what his or her market value might be.
And with all the on-line classes being offered now an athlete will be able to enroll without actually entering a classroom.
College and University Presidents and Chancellors should inform their athletic departments that they must ensure that enrolled athletes are making progress towards graduation during their years of eligibility, even if they're just passing through on their way to a better NIL package.
