And is universally understood to be so.
This wasn't a love tap, or a "get away from me" push.
It was a deliberate act that cannot be justified by anything that came before it.
Ultimately, I think the case will all turn on the judge's instructions to the jury; assuming it gets that far.
I can see a set of instructions where the jury is asked to determine if:
1) Jones punched Szabo?
2) the punch caused Szabo to fall to the ground and hit his head?
3) Szabo died from blunt force trauma to the head (as the coroner has already determined)?
It's unlikely the jury will be instructed to consider whether Szabo being drunk contributed to his fall, or his death; although I'm sure the defense attorney will argue that.
And don't forget the two most important facts in this case; Jones is black and Szabo is white.
